Uncover the TRUTH behind the Maggie Pond tax scheme: Vote NO!

This website was established by a large consortium of local property owners in Breckenridge — led by Trails End, Powderhorn, and The Cedars. We are concerned about the undemocratic attempt by several commercial interests (The Village at Breckenridge and Vail Resorts) to jam an unfair property tax on a small set of properties to enrich their own interests and shirk their property-management responsibilities.

Property owners deserve the facts behind this plan

This consortium is expected to grow as more property owners — inside and outside the proposed district boundary — understand the facts behind the Special Tax District proposal, the magnitude of the tax hike, and the pitfalls of using a Special Purpose District in this manner. Property owners within the proposed district, along with property owners everywhere in Breckenridge, should take note of this trickery and learn the truth behind this devious plan.

Serious concerns

What's wrong with the proposed Consumption / Entertainment District

Beyond the tax itself, the plan leaves basic questions about infrastructure, governance, and impact on neighbors unanswered.

Parking and restrooms are not addressed. Parking in this part of town is already seriously lacking — it will likely lead to more trespass parking on condo and homeowner sites nearby.

The noise, traffic, and trash implications for nearby homeowners have not been considered.

If it is truly a public space, it should not be governed by a separate entity that has its own commercial interests front and center. Does the Town really need an open consumption area with its own governance and programming that may compete for tourism events?

The success of the area may come at the expense of local food and beverage establishments on Main Street that are not in the District.

The core problem

Why is it UNFAIR?

Three reasons this proposal is fundamentally UNFAIR — and abuses the Special Tax District construct.

UNFAIR · Decades of neglect

A tax to cover their own dereliction

Maggie Pond needs development because the current property owners have been derelict in maintaining their own property for decades — and are now turning to tax-code trickery, abusing the Special Tax District construct, to place an unfair and inequitable burden on a small set of owners to enrich themselves under the guise of "public good."

UNFAIR · Cost shifted & forever

A public benefit funded by a private few

They want to create a public space that benefits the entire town, yet the funding comes from a special tax on a small set of nearby properties — a tax that will exist forever. They've also shifted the burden onto residential owners by artificially creating a "discounted" mill levy just for commercial properties in the district, sidestepping how Colorado levies commercial vs. residential property tax.

UNFAIR · Zero representation

The voting itself is unfair

Homeowners who hold their property in an LLC or Trust — commonly used for liability management and estate planning — will not get to vote. That is zero representation for a tax they would be forced to pay.

Community input missing

A plan built behind closed doors

Attempts by members of this consortium to learn about the process and help find optimal ways to improve Maggie Pond for the entire town were dismissed. Instead, a small group of interests — coordinated by The Village at Breckenridge — operated clandestinely, holding behind-closed-door meetings to concoct a plan that forces massive property taxes on a small set of owners from nearby complexes.

While everyone largely supports the goal of improving Maggie Pond for the whole town to enjoy, the use of a narrowly-defined Special Tax District (and likely eminent domain to acquire the land) is not appropriate.

Any assertion that the community and current property owners in the Special Tax District have been involved in forming this "tax enrichment plan" is an absolute lie. The community has not been engaged in any collaborative discussion, despite a planning process that has apparently been underway for several years.

Plans to shirk their own financial responsibility and jam a tax on neighbors have been underway for years — as documents obtained from HOA board minutes and the Town of Breckenridge through Colorado Open Records Requests have proven. This website exists so the community can actually engage in conversation, instead of the "one-way" meetings staged as a guise for real engagement.

Egregious claims & an unfairly expanded boundary

The "ownership map" was riddled with lies

On July 9th, the commercial interests behind this plan held an event and presented material riddled with egregious lies about who actually owns Maggie Pond — we believe, to trick voters into thinking the proposed boundaries are fair. Spreading knowingly false information to mislead the public and voters is about as low as you can go.

Trails End
What they told the public

"Owns 0.08 acres of pond bottom and 200 linear feet of Maggie Pond's east and west shorelines."

Lie!

Trails End does not own any part of Maggie Pond — nor any shoreline around it.

The Cedars
What they told the public

"Through its membership within the Upper Village HOA, owns 1.71 acres that abuts Maggie Pond's southwest shoreline and drains into Maggie Pond."

Lie!

Being part of an HOA does not grant ownership of any part of the property. The Upper Village HOA includes many properties — why are they not included? Most of them were excluded from the district.

Powderhorn HOA
What they told the public

"Through its membership within the Columbine Master HOA, owns 0.43 acres of pond bottom and 191 linear feet of Maggie Pond's southwest shoreline."

Being part of an HOA does not grant ownership of any part of the property. The Columbine Master HOA includes many properties — why are they not included?

Under the organizers' own logic, the entire membership of the Upper Village and Columbine HOAs would have to be included in the district. The real owners of the pond and adjoining land is mainly Vail Resorts, The Village at Breckenridge, Main Street Station, and Hotel Breckenridge. The Upper Village HOA and Columbine HOA are small owners — and Trails End, Powderhorn, and The Cedars are merely members of these master HOAs, and membership is not ownership.
